Dallas County challenges Fifteenth Court's constitutionality

This week, Dallas County asked the Texas Supreme Court to weigh in on whether the new Fifteenth Court of Appeals is constitutional. Congress gave the newly created Fifteenth Court jurisdiction over all appeals challenging the constitutionality of a statute, appeals where the State of Texas is a party, and appeals from the newly constituted business courts. Dallas County argues that the Fifteenth Court is statewide jurisdiction over these types of cases violates the Texas Constitution's requirement that the state be "divided" into court of appeals districts.
